Richard's Last Witness

Chapter 15 - Richard's Last Witness
The trust hearing took place in probate court.
Evelyn's attorneys argued that Richard lacked full capacity when he amended the trust.
If the amendment was invalidated, older terms would return.
Adrian could potentially request broader reimbursements if his custody increased later.
Claire wondered why Evelyn continued fighting.
Then Susan answered the question.
Control.
It had always been control.
The hearing seemed to be going Evelyn's way until an unexpected witness appeared.
Richard's longtime nurse, Helen Morris.
Claire remembered her.
A quiet woman with silver hair who had cared for Richard during his final year.
Helen testified that Richard was mentally sharp when he signed the amendment.
Then she revealed something no one expected.
Richard had asked her to witness a conversation with Evelyn.
"He told Mrs. Bennett that the trust would never be used to rescue Adrian again."
Evelyn shook her head.
Helen continued.
"Mrs. Bennett told him, 'Then I'll find another way.'"
The room went still.
Evelyn's attorney objected.
The judge allowed limited testimony.
Helen produced notes she had written that same evening as part of Richard's care record.
Date.
Time.
Exact statement.
Evelyn's challenge began to collapse.
After court, Evelyn approached Claire.
For once, she looked old.
Not elegant.
Not powerful.
Just tired.
"You turned my husband's last months into evidence."
Claire stared at her.
"No."
She thought of the envelope.
The recording.
The nurse.
The warnings Richard had scattered everywhere because he did not trust his own family to listen.
"Richard did."
Evelyn's eyes filled with tears.
"He loved Adrian."
"I know."
"Then why did he do this?"
Claire answered quietly.
May you like
"Maybe because loving someone and enabling them are not the same thing."
Evelyn had no reply.
